These Terms & Conditions ("Terms") govern your access to and use of the FUTUREDUST.CO website and your purchase of any products, digital goods, or design services offered through it (together, the "Services"). By browsing this site or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.

1. Who we are

The Services are operated by FUTUREDUST.CO ("FUTUREDUST," "we," "us," or "our"), an independent design studio creating racing liveries, helmet designs, apparel, and digital media. You can reach us any time at hello@futuredust.co.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By purchasing, you confirm that the information you provide is accurate and that you are authorized to use the payment method you select.

3. Products & services

We offer three broad categories of Services: physical goods (such as apparel and stickers), digital goods (such as downloadable icon sets and artwork), and custom design commissions. We work to represent product colors, materials, and details as accurately as possible, but we cannot guarantee that your device renders them exactly. Minor variation between the images shown and the item you receive is normal.

4. Orders, pricing & payment

All prices are listed in US dollars unless stated otherwise and exclude any taxes or duties that may apply. We may correct pricing errors, refuse or cancel an order, and limit quantities at our discretion. Payment is handled securely through Shopify and its payment providers; we do not store your full card details. Your order is confirmed only once payment has been received.

5. Shipping & delivery

Physical orders are typically dispatched within 2 business days and shipped worldwide. Delivery timeframes are estimates and are not guaranteed. Risk of loss passes to you once an order is handed to the carrier. Any customs fees, import duties, or taxes charged on international shipments are your responsibility.

6. Returns, refunds & cancellations

If a physical product arrives damaged, defective, or incorrect, contact us within 14 days of delivery and we will arrange a replacement or refund. Returned items must be unused and in their original condition. Made-to-order and personalized items may not be eligible for return except where they are faulty. Shipping charges are non-refundable unless the return is the result of our error.

7. Digital products

Digital goods are delivered electronically and made available for download after purchase. Because digital items cannot be returned once accessed, all sales of digital products are final. Unless a product states otherwise, digital goods are licensed to you for personal, non-commercial use only; you may not resell, redistribute, or sublicense them.

8. Custom commissions & design work

Custom liveries, helmet designs, and other bespoke work are subject to a separate project scope agreed in writing before work begins. Commissions generally require a non-refundable deposit to reserve a slot, with the balance due before final files are released. Each project includes a defined number of revision rounds; additional revisions may incur further charges. Timelines are estimates and depend on timely feedback and asset delivery from you.

9. Intellectual property

All content on this site — including artwork, designs, graphics, logos, text, and code — is owned by FUTUREDUST or its licensors and is protected by intellectual property laws. Purchasing a physical or digital product does not transfer ownership of the underlying artwork or grant any right to reproduce it beyond the license expressly provided. For commissioned work, ownership and usage rights are defined in the applicable project agreement; unless otherwise agreed, FUTUREDUST retains the right to display completed work in its portfolio.

10. Client-supplied materials

If you provide logos, sponsor marks, photographs, or other materials for a commission, you confirm that you own them or have permission to use them, and you grant us the license needed to complete your project. You agree to indemnify us against any claim arising from materials you supply.

11. Acceptable use

You agree not to misuse the Services, including by attempting to disrupt the site, infringe the rights of others, use our work to promote hateful or unlawful content, or reproduce our designs without authorization. We may suspend or terminate access for anyone who violates these Terms.

12. Third-party links & services

Our site may link to third-party platforms such as social media, Trading Paints, or payment providers. We are not responsible for the content, policies, or practices of those third parties, and your use of them is at your own risk.

13. Disclaimers

The Services and all products are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

14. Limitation of liability

To the maximum extent permitted by law, FUTUREDUST will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or goodwill, arising from your use of the Services or products. Our total liability for any claim will not exceed the amount you paid for the product or service giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless FUTUREDUST and its collaborators from any claims, damages, or expenses arising out of your breach of these Terms or your misuse of the Services.

16. Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law rules. Any dispute will be subject to the exclusive jurisdiction of the courts located there, unless applicable law requires otherwise.

17. Changes to these Terms

We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
